The DJGraphics terms

  • Any contract between DJGraphics and the Client will be on these conditions, to the dismissal of all any variations to these conditions shall have no effect unless agreed in writing and/or by email.
  • Any work to be carried out by DJGraphics shall be done in our own time by a confirmation order email.
  • Email will be our only method of contact; it allows us to stay in contact between various Clients efficiently. Although DJGraphics does have a telephone number, email shall be our method of contact and as such it is in the Client’s importance to inform us of any change of email address. DJGraphics will not be held responsible for any miscommunication problems relating to an incorrectly supplied email address by the Client. DJGraphics will aim to reply to all emails within 3 working days (mon-fri)
  • DJGraphics will only begin work on a design project after acceptance of a non refundable deposit of the final quoted design fee from the Client. The final payment is to be made in full on completion of the design work. The final design work will be handed over to the Client once full payment has been cleared.
  • The deposit is non refundable. The deposit paid to DJGraphics will cover the initial cost of design work carried out (i.e. any stock photography) as well initial communication and admin costs.
  • DJGraphics assumes the Client will carry out satisfactory analysis before proceeding with any design work. This includes the process of checking that a website/design/business/idea will operate legally in its governing nation. We do not condone designing websites for any illegal activity.
  • It is if the upmost necessity for the Client to keep in touch with DJGraphics during the project design. If the Client does not respond to any DJGraphics contact for 2 weeks - we shall make 4 further attempts via the email originally provided before project cancellation. The deposit made will not be refunded and the contract will be terminated. A £30 admin charge is payable if the Client then wishes to presume work within the next 6 weeks.
  • Stock images may be purchased on behalf of the Client by DJGraphics and used in design work. This stock photography used in a design are strictly for that design only. DJGraphics will not be held responsible for abuse of these images by the Client or anyone else to be found sharing, copying, and relaying the image to another company or organisation.
  • DJGraphics will gladly host any website if the Client requires us to. This will be on receipt of full payment of the agreed hosting fees. In doing so, DJGraphics shall strive to provide a professional and reputable hosting service however 100% website uptime may not be achieved as is with any host, especially in the event of a freak technical problem.
  • Standard website hosting offered by DJGraphics is limited to 1GB of website space unless otherwise stated in a separate contract.
  • DJGraphics will not be held responsible for anything relating to and/or affecting the Client’s business sales or profitability that could be claimed as a consequence of any service offered by DJGraphics.
  • When partaking in SEO (search engine optimisation) work DJGraphics can never guarantee a specific search engine placement.
  • When updating/ changing/ altering a pre-existing website there is a possibility of it affecting the websites ranking in search engines. DJGraphics may not be held responsible for any damages caused as a result for anything done on the client's behalf.
  • DJGraphics will provide the Client with an estimated completion date for the design work. DJGraphics shall work to try and meet this deadline however does not guarantee and is not held liable for not making the specified date. Any estimate provided by a DJGraphics employee is only an estimate and as such cannot be held as a contracted date.
  • If open source software should be used then the Client shall not be charged for the actual software. If there is a charge on the receipt then this is for the time to install the software. Open source software will always remain property of the software provider on nor DJGraphics or the Client. It is the client's obligation to find out whether his/her website is running on open source software.
  • DJGraphics will remain sole owner of all of the design and coding of work until a final payment has been received and cleared in full. Upon clearing, the Client will then own the design and code of the website, unless open source software is used.
  • Should any legality issues arise from the use of copyrighted content/ images supplied by the Client or DJGraphics, they will be the sole responsibility of the Client and not DJGraphics.
  • Domain names will be registered by DJGraphics and also registered to the DJGraphics current address. Although the domain names are registered to DJGraphics, any domain names themselves will be owned by the client and if required DJGraphics will transfer the domains elsewhere within a fair timescale.
  • Domain names will only be registered and purchased once the deposit has been paid in full. Then and only then can DJGraphics guarantee the availability of hosting a website at that address. Up to that point, anyone may come in also register the web address.
  • It is the sole responsibility of the Client to renew their domain names when due (.co.uk/ 2 years and .com/ 1 year). If a domain name expires, DJGraphics cannot be held liable. DJGraphics will however make effort to get in contact with the Client regarding domain renewal.
  • Renewal of Hosting is due on a yearly basis. The date of renewal will be annually from the date the website was made live. The Hosting will not be renewed if DJGraphics cannot contact the Client or the Client requests for DJGraphics to not host this site.
  • The hosting renewal receipt must be cleared within 20 days of the Hosting expiry date. DJGraphics reserves all rights to deactivate any website where hosting has expired and the Client hasn't paid the hosting renewal charge. There will be a £30 fee set by DJGraphics for reactivating the website/Hosting if the client wishes to do so.
  • DJGraphics does not tie the Client down to hosting on their own services. If the client wishes to host the website elsewhere then it is consequently his/her responsibility to deal with hosting and domain renewal
  • Should a Client wish to move web hosting away from DJGraphics or transfer a domain name away from DJGraphics, a £30 admin charge will be issued, which must be paid before the transfer takes place.
  • DJGraphics will place a small text link on the footer of a Client's website that simply states the website was designed by DJGraphics. DJGraphics also reserves the right to link to partner sites in the footer link. The Client may not remove any of these links under any condition unless agreed in another separate contract.
  • DJGraphics are not liable for damage or corruption to files or information stored on its servers or individual PCs relating to a Client’s website. The Client is solely responsible for any information or files relating to its website.
  • DJGraphics accept payments using a credit or debit card via Paypal. It is our sole card payment method. DJGraphics also accepts payment by cheque. DJGraphics will only start work once payment has been cleared.
  • DJGraphics makes no assumptions that the contents of this website or and website designed and possible hosted by us may be lawfully viewed or downloaded outside England and Wales. Access to any website may not be legal by certain personnel or in certain countries. If this website is accessed from outside of the United Kingdom, it is done at the visitors' own risk and the visitor is responsible for compliance with the relevant laws of their jurisdiction.
